These Terms and Conditions ("Terms") govern your use of our audiovisual rental and/or labor services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Definitions
- "Company" refers to Camera Crew LLC, the provider of audiovisual services.
- "Client" refers to the person or entity renting equipment and/or hiring services from the Company.
- "Equipment" refers to the audiovisual equipment rented by the Client from the Company.
- "Services" refer to the delivery, setup, operation, and maintenance of the audiovisual equipment provided by the Company.
2. Booking and Payment
- Quotes and Proposals: All quotes and proposals are valid for 24 hours unless otherwise specified. Pricing is subject to change after the expiration date.
- Reservations: Your reservation for equipment and services is confirmed upon receiving an acknowledgment from our company email address (@cameracrewllc.com)
- Payment Terms: Full payment is due prior to the event, unless otherwise agreed in writiing.
- Day Rates: A day rate constitues a 10 hour day.
- Overtime: 10+ hours = time-and-a-half
14+ hours = double time
3. Cancellations and Refunds
Cancellation by Client: If the Client cancels the reservation, the following fees apply:
- Less than 30 days but more than 7 days before the event: 25% of the total equipment and labor costs.
- Less than 7 days but more than 48 hours before the event: 50% of the total equipment and labor costs.
- Less than 48 hours before the event: 100% of the total equipment and labor costs.
Cancellation by Company: The Company reserves the right to cancel the booking in case of force majeure events, safety concerns, or other reasons beyond its control. In such cases, the Client will receive a full refund of any payments made.
4. Operation and removal
- Operation: If the Company provides personnel to operate the Equipment, the Client must ensure that the event schedule is adhered to and inform the Company of any changes in advance.
- Removal: The Client must ensure that the Equipment is ready for pickup and accessible.
5. Client Responsibilities
- Care of Equipment: The Client is responsible for the Equipment from the time of delivery until pickup. The Client must take all reasonable precautions to protect the Equipment from damage, loss, or theft.
- Use of Equipment: The Equipment must be used in accordance with its intended purpose and operated only by trained personnel. Unauthorized or improper use may result in additional charges or liability for damages.
- Permits and Permissions: The Client is responsible for obtaining any necessary permits or permissions required for the use of the Equipment at the event location.
6. Liability and Insurance
- Company Liability: The Company is not liable for any direct or indirect loss, damage, or injury arising from the use or operation of the Equipment.
- Client Liability: The Client is liable for any damage to or loss of the Equipment while under their control. The Client agrees to reimburse the Company for any repair or replacement costs.
7. Indemnification
The Client agrees to indemnify and hold the Company harmless from any claims, liabilities, damages, or expenses (including legal fees) arising from the Client’s use of the Equipment or services.
8. Changes and Amendments
The Company reserves the right to amend these Terms at any time. The Client will be notified of any significant changes in advance.
9. Governing Law
This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of Missouri, without regard to the conflict of laws principles thereof.
